SUBJECT : Railway Fares Charged to Koreans.

１．Reference is made to the following:

　　a．Letter from the Imperial Japanese Government, C.L.O. No. 313 (5.3), dated 21 January 1946, subject as above.

　　b．Memorandum from this headquarters, fill AG 370.05 (9 Dec 45)GC, dated 9 December 1945 subject: "Supplies, Transportation and Facilities for Repatriates."

２．The provisions of paragraph 2c of reference 1b above are retroactive to 15 October 1945.

３．Where refunds are made they should be made to individuals unless an organization has legal proof that it is acting as the agent for such individuals under a proper power of attorney.

４．The matter of refunds to employers for fares paid in behalf of Korean employees is a matter for settlement between the Imperial Japanese Government and the employers concerned.

１．Reference is made to the following memorandums from this headquarters:

　　a．File AG 370.5 (17 Nov 45)GC, dated 17 November 1945, subject: "Repatriation of Non-Japanese from Japan."

　　b．File AG 370.05 (17 Nov 45)GC, dated 17 November 1945, subject: "Reception Centers in Japan for Processing Repatriates."

２．In order to facilitate the functioning of the Korean repatriation program it has been decided to route Korean repatriates to ports of embarkation and embark them on ships according to the repatriates' destination in Korea.

３．The Imperial Japanese Government will:

　　a．Transport repatriates from Japan to Korea on Japanese merchant shipping and LST's operated, manned, victualled and provisioned by the Japanese under the direction of SCAJAP.

　　b．Send Koreans to be repatriated from Japan to reception centers and embark them on vessels destined for ports in Korea in accordance with the following routing:

SUBJECT : Repatriation of Korean Prisoners.

The Imperial Japanese Government will not repatriate Korean civil prisoners in Japan until they have served their term of imprisonment and are duly released from confinement. This shall not be construed as in any way infringing the prerogative of the Japanese Government to remit or mitigate such sentences.

MEMORANDUM FOR : JAPANESE GOVERNMENT.

SUBJECT : Registration of Koreans, Chinese, Ryukyuans and Formosans.

１．The Imperial Japanese Government will register all Koreans, Chinese, Ryukyuans and Formosans resident in Japan by 18 March 1946.

２．Registration will include:

　　a．Name

　　b．Age

　　c．Sex

　　d．Place of residence in native land.

　　e．Place of residence in Japan.

　　f．Occupation.

　　g．Statement of desire concerning repatriation.

　　h．In the case of those desirous of repatriation, the destination in repatriate's native land.

３．Those registering as not desirous of repatriation forfeit their privilege of repatriation.

４．Individuals having received notification to register and failing to do so at or prior to the appointed time will be considered as not desiring repatriation and will forfeit their privilege of repatriation.

５．Upon completion of registration the Imperial Japanese Government will report the following information to this headquarters:

　　a．The total number of Koreans, Chinese, Ryukyuans and Formosans resident in Japan.

　　b．The number of each nationality desiring repatriation.

　　c．The total of Koreans desiring repatriation will be sub-totaled to show:
　　　（1）Total of those whose destination is northern Korea (that portion of Korea north of 38 degrees north latitude).
　　　（2）Total of those whose destination is Korea south of 38 degrees north latitude.

　　d．The total of Ryukyuans desiring repatriation will show the sub-total for each destination island.

　　e．The total of Chinese desiring repatriation will be sub-totaled to show the number destined for North, Central, and South China respectively.

６．Prior to registration and again at the time of registration the Imperial Japanese Government will inform the Koreans, Chinese, Ryukyuans and Formosans that:

　　a．They are to be registered for the purpose of determining their desire or non-desire for repatriation.

　　b．Failure to register will be grounds for forfeiture of repatriation privileges.

　　c．Those registering as desirous of repatriation will be required to undergo repatriation in accordance with instructions issued by the Japanese Government or forfeit their repatriation privileges.

　　d．That those registering as desirous of remaining in Japan forfeit their repatriation privileges.

MEMORANDUM FOR : Imperial Japanese Government.
THROUGH : Central Liaison Office, Tokyo.
SUBJECT : Exercise of Criminal Jurisdiction.

１．Japanese courts will henceforth exercise no criminal jurisdiction over United Nations Nationals or organizations, including corporations. All pending criminal proceedings in which Nationals of the United Nations are defendants will be reported to this headquarters; further action by Japanese Courts with respect to such defendants will be stayed; and the defendants will be held subject to directions from authorized representatives of the Supreme Commander for the Allied Powers.

２．Japanese courts will henceforth exercise no criminal jurisdiction over the following offenses:

　　ａ．Acts prejudicial to the security of the Occupation Forces, or any member thereof, or any person attached to or accompanying such forces.

　　ｂ．Killing or assaulting any member of the Occupation Forces or any person attached to or accompanying such forces.

　　ｃ．Unauthorized possession, taking, receipt or disposal of property of the Occupation Forces or any member thereof, or of any person attached to or accompanying such forces.

　　ｄ．Interfering with or hindering the arrest of any person sought, or assisting in or furthering the escape of any person detained, by the Occupation Forces or/by others pursuant to the direction of the Supreme Commander for the Allied Powers or his authorized subordinates.

　　ｅ．Interfering with, refusing information required by, making any false or misleading statement orally or in writing to, or defrauding in any manner, any member of the Occupation Forces or any person attached to or accompanying such forces in a matter of official concern.

　　ｆ．Acts on behalf or in support of any organization dissolved or declared illegal by the Supreme Commander for the Allied Powers or dissolved or declared illegal at the order of the Supreme Commander for the Allied Powers.

　　ｇ．Conspiracies to commit, or acts which aid or abet the commission of, any of the foregoing offenses.

３．Japanese courts will continue to exercise jurisdiction over acts prejudicial to the objectives of the occupation insofar as such acts constitute violations of Japanese law. However, military occupation courts may also assume jurisdiction over such acts or any other acts which are prejudicial to the objectives of the occupation.

４．The Commanding General of the Eighth Army and the Commander, Fifth Fleet, have been directed to appoint military occupation courts including commissions and provost courts with jurisdiction over the foregoing persons and offenses.

５．ａ．Military commissions are authorized to impose sentences which may include:- fines; imprisonment at hard labor, or both, or specified alternative imprisonment in lieu of payment of fines; expulsion; confiscation, padlocking and forfeiture of estates; and death.

　　ｂ．Provost courts are authorized to impose sentences including:- fines not to exceed Seventy-five thousand (\75,00O) Yen; imprisonment at hard labor not to exceed five (5) years, or both, or specified alternative confinement in lieu of payment of fine; expulsion; confiscation and padlocking respecting properties not exceeding Seventy-five thousand (\75,000) Yen in value.

６．The Imperial Japanese Government shall have no authority to arrest United Nations Nationals, except (a) in areas where Allied troops are not actually present on duty and there is a reasonable evidence ~~suspicion~~ that a serious crime has been committed by a United Nations National, or (b) when otherwise directed by the Supreme Commander for the Allied Powers or his authorized subordinates: provided that, when such persons are taken into custody, the apprehending authority will immediately report the incident to the nearest Allied Military Authority and deliver such persons upon instructions from such Authority.

７．The Japanese people and all other persons in Japan will be informed of this directive.

＊本来は「a reasonable suspicion(相当の嫌疑)」だが、1946年9月19日付SCAPIN1218「民事及び刑事裁判管轄権についての覚書修正」によって「 reasonable evidence(相当の証拠)」に修正されたのが反映されている

１．日本裁判所は、今後連合国の国民、または法人を含む団体に対して刑事裁判権を行使してはならない。連合国民を被告とする全ての審理中の刑事訴訟は、この司令部に報告されることを要する。日本裁判所はその被告人に関する今後の措置を停止しなければならない。そして被告人は、連合軍最高司令官の権限ある代理者の指示に服させておかねばならない

２．日本裁判所は今後以下の犯罪に対して刑事裁判権を行使してはならない
　　ａ．占領軍、その将兵または占領軍に付属もしくは随伴する者の安全に害を与える行為
　　ｂ．占領軍、その将兵または占領軍に付属もしくは随伴する者の殺害または傷害
　　ｃ．占領軍、その将兵または占領軍に付属もしくは随伴する者の財産の無権限の占有、取得、受領または処分する行為
　　ｄ．連合軍最高司令官もしくはその権限のある部下の指示に従い占領軍または他の者によって捜索されている者の逮捕に対する干渉もしくは妨害、または拘留中の者の逃亡を幇助する行為
　　ｅ．占領軍将兵または公務に関して占領軍に付属もしくは随伴する者に対する干渉、その者の要求する情報の拒否、その者に対する虚偽もしくは紛らわしい口頭もしくは文書による陳述、またはあらゆる方法による欺瞞
　　ｆ．連合軍最高司令官によって解散されたか非合法と宣言された、あるいは連合軍最高背司令官の命令によって解散されたか非合法と宣言された団体に代わるもしくは支持する行為
　　ｇ．前述の犯罪について共謀もしくは幇助もしくは教唆する行為

３．日本裁判所は占領目的に害を与える行為に対して、それが日本の法律違反を構成する限り、裁判権の行使を継続する。しかし、占領軍事法廷も同様にそのような行為あるいは占領目的に害を与える他の行為に対して裁判権を行使する

４．第8軍司令官と第5艦隊司令官は、前述の者と犯罪に対する裁判管轄権を有し、軍事委員会及び憲兵裁判所を含む軍事占領裁判所を任命するよう指令されている

５．ａ．軍事委員会は、罰金、重労働に従事する収監あるいはその両方、罰金の支払いに代わる選択肢として指定された収監、追放、財産の没収、差し押さえと喪失及び死刑を含む判決を下す権限を与えられる
　　ｂ．憲兵裁判所は、75,000円を超えない罰金、5年を超えない重労働に従事する収監、あるいはその両方、罰金の支払いに代わる選択肢として指定された禁錮、追放、75,000円の価値を超えない所有物の没収及び封鎖を含む判決を下す権限を与えられる

６．日本政府は、(a)連合軍部隊が現在実際に駐屯していない地域で連合国民によって重大犯罪が犯されたという相当の証拠嫌疑がある場合、(b)さもなくば、連合軍最高司令官もしくはその権限のある部下による指示がある場合を除き、連合国民を逮捕する権限がない。もしそのような者が逮捕されたなら、逮捕した官憲は即座に最寄りの連合軍官憲に事件を報告し、その指示があったときはその者を引き渡すこと

７．この指令は日本国民と日本にいる全ての者に通知されること

SUBJECT : Review of Sentences Imposed Upon Koreans and Certain Other Nationals.

１．Reference is made to memorandum for Imperial Japanese Government AG 015 (19 Feb 46) LS, subject "Exercise of Criminal Jurisdiction".

２．Sentences imposed by Japanese Criminal Courts on Koreans and other nationals of countries formerly under the domination of Japan, who furnish adequate proof of their intention to return to their homelands, shall be subject to review and further action by the Supreme Commander for the Allied Powers or his designated representatives. However, such a review will be made and action taken only after remedies in Japanese Courts reasonably available to the defendant have been exhausted and at the request of the person upon whom sentence has been imposed.

３．The action by the Supreme Commander for the Allied Powers or his designated representatives may include staying of execution disapproval, suspension, mitigation, remission in whole or in part, or commutation, but will in no way operate to increase the sentence imposed.

４．The Commanding General, Eighth Army, has been designated as a representative of the Supreme Commander for the Allied Powers for the accomplishment of the review and action specified above.

１．This memorandum is the basic directive governing repatriation of:

　　ａ．Japanese nationals from areas under the military control of:

　　　　Commander-in-Chief, United States Army Forces, Pacific.

　　　　Commander-in-Chief, Pacific Ocean Areas.

　　　　Generalissimo, Chinese Armies.

　　　　Supreme Allied Commander, Southeast Asia Command.

　　　　General 0fficer Commanding, Australian Military Forces.

　　　　Commander-in-Chief, Soviet Forces in the Far East (when appropriate agreements have by consummated).

　　ｂ．Displaced persons in Japan formerly domiciled in China, Formosa, Korea and the Ryukyus.

２．Previous instructions, as contained in the memorandums listed in Annex Ⅷ hereto, are superseded by this directive. It will be noted that memorandum, file AG 033 (17 Feb 46)GC (SCAPIN-746), dated 17 February 1946, subject: Registration of Koreans, Chinese, Ryukyuans and Formosans, remains in effect until action directed therein is completed.

３．In the future, so far as practicable, all general directions concerning repatriation to and from the areas listed in paragraph 1 above, will be issued to the Imperial Japanese Government in the form of additions or amendments to this memorandum.

４．The Imperial Japanese Government will carry out the instructions as contained in annexes to this memorandum, under the supervision of the Commanding General, Eighth United States Army.

GENERAL POLICIES GOVERNING REPATRIATION OF JAPANESE NATIONALS IN FORMERLY JAPANESE OCCUPIED TERRITORY, AND NON-JAPANESE*, FROM JAPAN

The following policies will govern repatriation of Japanese nationals in formerly Japanese occupied territory, and non-Japanese from Japan.*

１．Maximum utilization will be made of Japanese naval and merchant shipping allocated for repatriation of Japanese nationals.

２．Japanese naval vessels and those Japanese merchant vessels, designed primarily for the transport of personnel and not required for inter-island or coastal passenger service, will be utilized for the repatriation of Japanese nationals.

３．Personnel to be repatriated will not be transported on cargo vessels to the extent that the essential cargo is displaced. Repatriates will be transported on cargo vessels destined only for authorized repatriation ports (see paragraph 2a, Annex Ⅱ).

４．The Japanese Government will operate, man, victual and supply Japanese-manned shipping used for repatriation to the maximum practicable extent. In case of emergency, fuel, food, medical supplies and material repairs may be obtained from U.S.Army or Navy sources, or at foreign ports from foreign government sources, by memorandum receipt signed by the master of the vessel concerned (see Annex Ⅳ).

５．First priority will be granted to the movement of Japanese military and naval personnel, and second priority to the movement of Japanese civilians. Exception may be made by the appropriate Allied area commanders as deemed necessary for areas under their control.

６．Only personnel being repatriated to and from Japan under the Japanese repatriation program or such others as may be authorized in special cases by the Supreme Commander for the Allied Powers will be transported on repatriation vessels.

　　＊The term "non-Japanese" as used in this annex and throughout this memorandum includes only Chinese, Formosans, Koreans, and Ryukyuans.

７．Non-Japanese nationals who have been repatriated to their homelands will not be permitted to return to Japan untill such time as commercial facilities are available, except as authorized by the Supreme Commander for the Allied Powers.

８．All Japanese personnel will be disarmed prior to return to Japan proper.

９．The Supreme Commander for the Allied Powers is responsible for making necessary arrangements concerning repatriation with other interested foreign governments.

１０．The Supreme Commander for the Allied Powers retains control over, and will make such arrangements as may be required for, the transportation to and reception in Japan of Japanese nationals evacuated from areas under the control of: the Generalissimo, Chinese Armies; the Supreme Allied Commander, Southeast Asia Command; the General Officer Commanding, Australian Military Forces; and the Commander-in-Chief, Soviet Forces in the Far East (the last when appropriate agreements have been consummated).

附則１

日本軍占領地の日本国民の引揚と、日本からの非日本人送還を規制する一般的方針

日本軍占領地の日本国民の引揚と、日本からの非日本人送還は、次の方針によって規制される

１．日本国民の引揚に割り当てられた日本海軍艦艇と商船を最大限に利用すること

２．日本海軍艦艇と商船で、主に旅客輸送にあてられ、内海または沿岸部の輸送に要求されていないものは日本国民の引揚のために利用されること

３．引揚者は、重要貨物の輸送を削減しない程度においてのみ貨物船で輸送すること。引揚者は許可された引揚港(附則２のパラグラフ2aを見よ)に向かう貨物船で輸送すること

４．日本政府は引揚に使用される日本人乗組船舶を実行可能最大限運航し、人員配置、食糧積込、供給をすること。緊急の場合、船舶船長の署名のある受領証によって、燃料、食糧、医療品及び修繕材料を米陸海軍、または外国港では外国政府から得られる

５．日本陸海軍人の移動に第１優先を、民間人の移動に第２優先を与えること。しかるべき連合国地域の司令官がその支配下地域に必要と考えた場合は例外が設けられる

RECEPTION CENTERS IN JAPAN FOR PROCESSING REPATRIATES

１．The Ministry of Public Welfare, having been designated by the Japanese Government to handle repatriation matters, will:

　　ａ．Establish a central agency to effect coordination with other Japanese governmental agencies regarding supply, customs, transportation, physical inspections, quarantine and demobilization, and to effect liaison with the headquarters of the Eighth United States Army.

　　ｂ．Establish and operate reception centers at designated ports (see paragraph 2a) to:

　　　（１）Receive, process, care for and evacuate all Japanese repatriates returning to Japan proper from overseas.

　　　（２）Assemble, process, care for and load non-Japanese nationals, as outlined in Annex Ⅲ.

　　ｃ．Designate a resident director at each reception center responsible for its operation and for maintaining liaison with local Allied Military authorities responsible for supervision of the reception center.

２．ａ．Reception Centers: Location, character and capacity.

　　　　Reception centers will be located as indicated below, and only these centers will be used for repatriation purposes:

The Ministry of Public Welfare will make arrangements with the Commanding General of the Eighth United States Army for assignment of necessary space for these facillities.

　　ｃ．Medical procedures.
　　　　Adequate inspection and quarantine stations, established at the above designated ports, will be operated in accordance with the procedures proscribed in Annex Ⅴ.

　　　　The establishment, organization and operation of each reception center will be under the supervision of the Allied military commander who exercises control over the area in which the reception center is located.

９．Shipping.

　　ａ．Japan - Korea Shuttles.

(１)Short range Japanese repatriation shipping in the Japan - Korea shuttles is redistributed to approximate the following percentages.

　 Hakata - 25%

　 Senzaki - 45%

　 Maizuru - 15%

　 Hakodate - 15%

　　　　（２）Information concerning the actual number of passenger spaces available at any time may be obtained from the Shipping Control Authority for the Japanese Merchant Marine.

　　ｂ．Japan - Korea - China shuttles.

　　　　（１）Empty spaces on vessels bound for northern Chinese ports will be filled with Koreans for debarkation in Korea.

　　　　（２）Certain Japanese shipping, shuttling between Shanghai and Hakata, may be loaded with Koreans at Hakata for debarkation at Pusan.

１０．Processing of Koreans through Japanese ports.

　　　ａ．In order to facilitate the functioning of the Korean repatriation program the Imperial Japanese Government will send Korean repatriates to Japanese reception center and embark them on vessels in accordance with the repatriates' destination in Korea. The Koreans will be routed as follows:

１１．Repatriation to Korea north of 38 degrees north latitude.

　　　Repatriation to northern Korea will be held in abeyance pending consummation of appropriate agreements. Koreans destined for northern Korea will be held in Japan until such time as they can be repatriated to northern Korea.

１２．Repatriation of Korean prisoners.

　　　ａ．The Imperial Japanese Government will not repatriate Korean civil prisoners in Japan until they have served their term of imprisonment and are duly released from confinement. This shall not be construed as in any way infringing upon the prerogative of the Imperial Japanese Government to remit or mitigate sentences.

　　　ｂ．The above is subject to the provisions of memorandum, from the Supreme Commander for the Allied Powers, file AG 015 (19 Feb 46)LS, (SCAPIN-757), dated 19 February 1946, subject: "Review of Sentences Imposed upon Koreans and Certain Other Nationals."

附則３

日本への及び日本からの送還

第１部　全体的計画

１．ａ．現在実施中の日本への及び日本からの送還を規定する計画は、連合国最高司令官から他の指令のない限り継続する
　　ｂ．本計画は地方引揚援護局の使用、利用可能な船舶及び鉄道輸送に適合する数量で地方引揚援護局を通しての送還者の出入に関するものを包括するものである

２．以下の地方引揚援護局は、日本から離れる非日本人送還者の処理に使用される

別府華南及び海南島居住の中国人の処理を主とする

博多及び舞鶴朝鮮人及び華中居住の中国人の処理を主とする

函館朝鮮人の処理を主とする

鹿児島琉球人の処理を主とする

佐世保朝鮮人及び華北居住の中国人の処理を主とする

呉地区台湾人の処理を主とする

仙崎朝鮮人及び華北居住の中国人の処理を主とする

３．厚生省は
　　ａ．関係各省と協議し、附則3のパラグラフ2aに示された受入能力に応じ、上記パラグラフ2で言及された援護局を、できる限り送出送還者で満たすよう必要な処置をとること
　　ｂ．提供される船舶運航スケジュールを慎重に調べ、次の条項を確実に実行するのに適切な行動を取ること
　　　　（１）地方引揚援護局が混雑しないこと
　　　　（２）朝鮮、台湾、琉球の港に向かう送還船舶は、これらの地域への送還者でできるかぎり収容能力いっぱいに満たすこと
　　ｃ．引揚送還者を処理終了後24時間以内に援護局から移動させるのに必要な輸送の手配をすること
　　ｄ．本国帰還を希望する非日本人を、本計画の条項に従った移動を支持するまでの間、現住地にとどめるよう制御すること

４．日本政府には以下の送還船舶の運航スケジュールが提供される
　　ａ．日本商船、海軍艦艇及び日本人乗組みの戦時標準船と上陸用舟艇に関してはSCAJAPより
　　ｂ．米人乗組みの上陸用舟艇及び他の連合国船舶については、それらが有り次第、連合国最高司令官より

５．日本政府は、地方引揚援護局を住居として使用することを禁止すること

６．非日本人送還者の輸送列車には警護員が乗車すること
　　ａ．米軍地方官憲は非日本人送還者を地方引揚援護局に輸送するため特別に計画される全列車に米軍警護員を乗車させるよう指令されている。警護員の数は送還者用車両1両につき2名
　　ｂ．日本政府は地方官憲に以下のように指令すること
　　　　（１）非日本人送還者を乗船港へ輸送する予定の全列車に警護員を同乗させるよう米軍地方官憲に要請すること。その要請には以下の情報を含むこと
　　　　　　　（ａ）輸送される非日本人送還者数
　　　　　　　（ｂ）非日本人送還者を輸送するため特別に計画された列車の車両数
　　　　　　　（ｃ）列車運行計画、行路及び目的地
　　　　（２）地方官憲に、命令の発出及び護衛兵の乗車を許可するにじゅうぶんな時間のあるよう要請を提出すること
　　　　（３）公務に服する他の連合国人に必要な車両を使用することなく、可能な限り米軍警護員用に適当な寝台車または一等客車を全行程を通じて用意すること。例外的な場合として、これらの提供が不可能なときは、代わりに二等客車を提供すること。車両は清潔であること

　　　　（４）列車運行の変更に関する完全且つ正確な情報を迅速に適当な地方軍官憲に提出すること
　　ｃ．日本政府は地方官憲に対して次のように指示すること

　　　　（４）連合国人乗組み船舶の船長に対して各グループの人員及びリーダーの名簿を提供すること
　　ｂ．日本地方官憲は、送還者が日本にいる間及び日本人乗組み船舶内にいる間、可能なあらゆる法的手段を利用して彼らを取り締まること

第２部　朝鮮への送還

８．以下の計画は朝鮮人の送還を規制するものである

　　　ａ．日本―朝鮮往復輸送
　　　　（１）日本－朝鮮往復輸送に使用の短距離用日本人引揚船は以下のパーセンテージのように再配置すること

１１．北緯38度以北の朝鮮への送還
　　北部朝鮮への送還は適当な時期に協定が締結されるまで中止される。北部朝鮮に向かう朝鮮人は北部朝鮮への送還が可能になるまで日本に留められる

１２．朝鮮人囚人の送還
　　　ａ．日本政府は朝鮮人囚人が刑期を終了し正当に釈放されるまで送還しないこと。これは刑の判決を取り消し、軽減する日本政府の権限を何らかの意味において侵害するものと解釈されない
　　　ｂ．上記は、1946年2月19日付SCAPIN757「朝鮮人及びその他の国民に言い渡された判決の再審理」の規定に従うものである

SUPPLY AND TRANSPORTATION

１．The following govern the provision of food, clothing, and other supplies for repatriates.

　　ａ．Adequate food, safe drinking water, clothing and medical supplies will be provided repatriates while enroute to and in the reception centers. Resupply will be arranged if trains are delayed while enroute to the reception centers.

　　ｂ．Japanese-manned vessels leaving designated ports in the home islands (paragraph 2a, Annex Ⅱ) will be provided by the reception centers with sufficient stocks of palatable food, safe fresh water, medical supplies, clothing and other items required for the ships crews and repatriates on the outgoing and return voyage plus one (1) day each way, except as bellow.

　　　　（１）Japanese-manned vessels in the Formosa - Japan shuttle will be provisioned from Japanese supplies now in Formosa.

　　　　（２）Japanese repatriation from Formosa will be outfitted with clothing from Japanese Army stocks now in Formosa.

　　ｃ．The Japanese Ministry of Welfare will furnish all non-Japanese repatriates outloaded on US-manned Landing Ships, Tank, with one (1) day's supply of pre-cooked rice and sufficient dry rice for the voyage plus one (1) day. The food will be palatable.

　　ｄ．United States repatriation vessels leaving designated ports in the Japanese home islands and which will return to Japan with repatriates, will be provided by the reception centers with sufficient stocks of food, medical supplies, blankets and other items required for the repatriates on the return voyage. During periods of cold weather in Japan, the Imperial Japanese Government will place aboard vessels departing from Japan sufficient warm clothing for repatriates to be returned to Japan from warm climates.

　　ｅ．The cost of supplies and facilities for repatriates will be borne by the Imperial Japanese Government.

　　ｆ．Retention of American military equipment by Japanese evacuees in Japan.

　　　　（１）In order that maximum utility may be gained from American military clothing and equipment issued by competent authority to Japanese evacuees, the Imperial Japanese Government is directed to take the following actions:

　　　　　　　（ａ）Collect all American clothing and equipment in the possession of repatriates as they are processed through reception centers.

　　　　　　　（ｂ）Re-outfit such personnel when necessary with Japanese clothing and equipment.

　　　　　　　（ｃ）American clothing and equipment, collected as directed in paragraph 1f (1) (a) above, may be used by the Japanese Government for relief purposes subject to the following:

　　　　　　　　　　１．All clothing or equipment of textile or fabric material will be dyed a distinctive color prior to issue.

　　　　　　　　　　２．All equipment such as shoes, canteens, etc, which cannot be dyed, will be marked or branded in the manner approved by the Supreme Commander for the Allied Powers.

　　　　　　　　　　３．Unless so dyed or marked, items will be confiscated by Allied authorities.

　　　　（２）The Imperial Japanese Government will report to the Supreme Commander for the Allied Powers as of the last day of each month the quantities of each item of American clothing and equipment dyed and marked and reissued to needy individuals during that month.

　　ｇ．Supplies of food and clothing for the reception centers will be levied proportionally on all prefectures of Japan.

２．Transportation.

　　ａ．Water transportation will be provided without cost to repatriates.

　　ｂ．Rail transportation will be provided without cost to authorized repatriates moving to reception centers under Japanese planned evacuation. This is retroactive to 15 0ctober 1945. The following governs payment of refunds:

　　　　　（１）When refunds are made they should be made to individuals unless an organization has legal proof that it is acting as an agent for such individuals under a proper power of attorney.

　　　　　（２）The matter of refunds to employers for fares paid in behalf of non-Japanese employees is a matter for settlement between the Imperial Japanese Government and the employers concerned.

　　ｃ．Vessels and trains will be clean, and adequate sanitary facilities therein will be provided.

　　ｄ．Adequate fire fighting equipment and life rafts will be provided Japanese-manned repatriation vessels.

　　ｅ．Quarters for US escort guards aboard vessels will be clean and the best available. Adequate sanitary facilities will be provided.

３．Emergency supplies furnished repatriation ships in foreign ports.

　　ａ．Arrangements are being made with the authorities who control ports outside of Japan to accept receipts for necessary supplies issued to Japanese-manned ships servicing those ports. At Formosa, when supplies are issued from Japanese Army stocks, no receipts will be necessary (see paragraphs 1b (1) and (2) above).

　　ｂ．Masters of Japanese-manned vessels engaged in repatriation will be instructed to furnish quantitative receipts for supplies obtained outside of Japan. Receipts will specify amount and kind of supplies and whether supplies will be used for Japanese troops or civilians.

　　ｃ．The Imperial Japanese Government will provide fuel, fresh water and food for all Japanese-manned vessels engaged in repatriation to the maximum extent practicable from Japanese sources. Accordingly Japanese-manned vessels will obtain supplies at overseas ports in minimum amounts necessary to complete their scheduled voyages.

４．Other Medical Supplies.

　　See paragraph 3, Annex Ⅴ.

附則４

供給と輸送

１．下記は送還引揚者に対する食糧、衣料及びその他の供給を規制する。

　　　　（２）台湾からの日本人引揚者に対する衣類補給は、現在台湾にある日本陸軍の貯蔵品から充当すること
　　ｃ．日本厚生省は、米人乗組み上陸用舟艇で送還される全ての非日本人送還者に対して、調理済みの1日分及び航海日数に1日分の余裕をみた未調理米を供給すること。ただし食糧は美味であること
　　ｄ．日本国内の指定港を出発し、引揚者を搭載して日本に帰る米国引揚船舶に対して、地方引揚援護局はじゅうぶんな食糧、医薬品、毛布その他復航時の引揚者に必要な物資を供給すること。日本において気候が寒冷な期間中、日本政府は気候温暖な地方より日本へ帰還する引揚者のために、日本出発の船舶にじゅうぶんな温かい衣料を積込むこと
　　ｅ．日本政府は、引揚送還者に対する供給並びに施設に関する経費を負担すること
　　ｆ．日本における日本人引揚者による米軍備品の保持
　　　　（１）日本人引揚者に対して米軍から支給された軍衣及び軍装品を最大限に利用するため、日本政府は以下の処置をとるよう指示される
　　　　　　　（ａ）地方引揚援護局を通して送還引揚者処理の時に、送還引揚者の所有する全ての米国製衣料及び備品を撤収すること
　　　　　　　（ｂ）そのような送還引揚者に対して必要な場合、日本製衣料及び備品を再支給すること
　　　　　　　（ｃ）上記パラグラフ1ｆの１aに指示されて撤収された米製衣料及び備品は、下記に従って日本政府が救済の目的に使用してもよい
　　　　　　　　　　１．織物または繊維を材料とする全ての衣料または備品は支給に先立って、区別できる色に染色すること
　　　　　　　　　　２．靴、水筒などのように染色できない備品は、連合国最高司令官に許可された方法で標識または烙印をつけること
　　　　　　　　　　３．染色または標識をつけない場合は、連合国当局によって没収される
　　　　（２）日本政府は、毎月末日現在における過去1ヶ月間内に、染色及び標識をつけ、必要者に再支給した米国製衣料並びに備品の各品目別数量を連合国最高司令官に報告すること
　　ｇ．地方引揚援護局への食糧及び衣料の供給は、日本の全県に公平に賦課すること

２．輸送
　　ａ．海上輸送は送還引揚者に対して無賃で行なう
　　ｂ．鉄道輸送は日本の移動計画に基いて地方引揚援護局へ移動する正当な送還引揚者に対しては無賃で行なう。これは1945年10月15日に遡及する。下記は乗車賃の払戻しを規制するものである
　　　　（１）払戻しを行なう場合は個人に対して行なわれるべきである。但し適当な権限を委任されて個人の代理人として行動する法的証拠を有する団体に対してはこの限りではない
　　　　（２）非日本人従業員に支払われた乗車賃の雇用主への払戻しの問題は、日本政府と当該雇用主との間で解決すべき問題である
　　ｃ．船舶及び列車は清潔にし、適当な衛生施設をその中に設置すること
　　ｄ．日本人乗組み送還引揚船舶には適当な消火設備と救命筏とを準備すること
　　ｅ．送還引揚船舶乗組みの米護送警護員の使用船室は清潔にし、最上のものとすること。また適当な衛生施設を準備すること

３．外国港において送還引揚船舶に提供される非常用供給物品
　　ａ．日本外の港に就航中の日本人乗組み船舶に対して交付される必要な供給物品の受領証を受納することを、これらの港の監督当局に手配しているところである。台湾においては日本陸軍貯蔵品から補給を受けた場合、受領証の発行を必要としない(上記パラグラフ1bの(1)(2)を見よ)
　　ｂ．送還引揚に従事する日本人乗組み船舶の船長に対して、日本外で得た供給物品の数量を表示した受領証を提出するよう指示すること。受領証には供給物品の数量及び種類、日本軍または一般日本人のどちらの使用に対して供給されたかを明記すること
　　ｃ．日本政府は送還引揚に従事する全ての日本人乗組み船舶に対して日本において得られる最大限の燃料、新鮮な飲料水及び食糧を供給すること。従って、日本人乗組み船舶は海外の港においてはその予定された航海を完了するのに必要な最小限の供給物品を得ること

１．Visits by Japanese Nationals to Korea.

　　ａ．All requests for permission for Japanese nationals to visit Korea will be disapproved unless, in the opinion of the Supreme Commander for the Allied Powers, visit is for the purpose of conducting business essential to the occupation of Japan and Korea.

　　ｂ．The settlement of private business matters by Japanese nationals and their assistance in welfare and relief work is not considered essential business as defined in a above.

１．日本国民の朝鮮渡航

１．Reference is made to Memorandum for the Imperial Japanese Government, file AG 370.05 (16 Mar 46)GC, (SCAPIN-822), dated 16 March 1946, subject: "Repatriation."

２．Paragraph 3c, Annex Ⅵ, subject: "Currency, Securities and other Documents and Possessions", of the reference memorandum is rescinded and the following substituted therefor.

　　"３．ｃ．Effective １ April 1946, permit them to carry with them their clothing and personal possessions of value only to the owner. These effects will be limited in weight to 250 pounds per person. The Imperial Japanese Government will take the necessary steps to handle this additional baggage without delaying the repatriation program".

３．Additions to or changes incorporated in above paragraph have been underlined.

１．Reference is made to the following Memorandums from the Spreme Commander for the Allied Powers:

　　ａ．File AG 370.05 (16 Mar 46)GC, (SCAPIN-822), subject: "Repatriation", dated 16 March 1946.

　　ｂ．File AG 370.05 (9 Apr 46)GC, (SCAPIN-872), subject: "Repatriation of Chinese, Formosans and Koreans".

２．Paragraph 1, Annex Ⅲ, reference 1a is amended by adding the following:

　　"ｃ．Under this plan non-Japanese nationals who, having registered as being desirous of repatriation, refuse to comply with plans of the Japanese Government for movement to reception centers forfeit their right to repatriation and will not be considered in any future repatriation plans. A list of such persons will be maintained by the Japanese Government".

３．ａ．Paragraph 9a Annex Ⅲ reference 1a is rescinded and the following substituted therefor:

　　　　"Effective 15 April 1946 short-range Japanese repatriation shipping on the Japan - Korea shuttles is redistributed to make available the following number of spaces daily:

　 Hakata 3000 　

　 Senzaki 1000 "

　　ｂ．Paragraph 9b (1) Annex Ⅲ reference 1a is hereby rescinded.:

４．Paragraph 10 Annex Ⅲ reference 1a is rescinded and the following substituted therefor:

　　"ａ．All Koreans who registered as desirous of repatriation will be cleared from Japan on or before 30 September 1946.

　ｂ．Koreans will be outloaded to Pusan from the following ports at daily rates indicated:

　 Hakata 3000

　 Senzaki 1000

　 Total 4000

　 Sufficient Koreans will be backlogged in these reception centers to insure that this daily rate of flow is maintained."

５．Paragraph 15, Annex Ⅲ, reference 1a above is rescinded effective 5 May 1946 and the following substituted therefor:

　　　"１５．Formosans desiring repatriation from Japan will be assembled at the Kure Recption Center during the week of 5 - 11 May 1946 for evacuation on Japanese-manned shipping."

６．Paragraph 22, Annex Ⅲ, reference 1a above is rescinded effective 13 May 1946 and the following substituted therefor:

　　"２２．Chinese desiring repatriation will be assembled on 13 May 1946 for evacuation as follows:

　　　　　ａ．Those whose destination is North China at the Sasebo Reception Center for shipment on Japanese or Japanese-manned shipping.

　　　　　ｂ．Those whose destination is Central China at the Maizuru Reception Center for shipment on Japanese or Japanese-manned shipping.

　　　　　ｃ．Those whose destination is South China at the Kure Reception Center for shipment to Canton on Japanese-manned shipping servicing the Southeast Asia areas."
