MEMORANDUM FOR : IMPERIAL JAPANESE GOVERNMENT.

SUBJECT : Suppression of Illegal Entry into Japan.

１．Reference is made to:

　　a．Memorandum from the Supreme Commander for the Allied Powers, file AG 014.33 (12 Jun 46)GC, (SCAPIN 1015), dated 12 June 1946, subject as above.

　　b．Memorandum from the Supreme Commander for the Allied Powers, file AG 014.33 (9 Aug 46)GC, (SCAPIN 1116), dated 9 August 1946, subject: "Suspension of Repatriation Through the Senzaki Reception Center.

２．The memorandums referred to above are rescinded and the following substituted therefor.

３．Since cholera is still prevalent in Korea, positive steps must be continued to detect and apprehend ships which are illegally transporting persons from Korea to Japan.

４．The Imperial Japanese Government will:

　　a．Continue in effect measures to detect ships illegally entering Japanese ports.

　　b．Seize all such ships and where possible sail them together with their crews, passengers and cargo to Sasebo or Maizuru and deliver them to United States military authorities at those ports.

　　c．Place all Korean illegal immigrants apprehend in Japan in cholera quarantine and otherwise medically process them according to existing memoranda covering entrance of persons into Japan. Upon clearance by quarantine officials, transport them to the Sasebo Reception Center by rail.

　　d．Outload Korean illegal immigrants from the Sasebo Reception Center on shipping designated for this purpose.

　　e．Furnish Japanese police for guards aboard train and repatriation ships transporting Korean illegal immigrants.

５．Necessary Allied guards to lend the necessary support and prestige to Japanese police guards and coordinate their activities may be secured on request to the local Allied commander.

　　ｃ．日本で逮捕された朝鮮人不法入国者を全てコレラ検疫所に収容すること、あるいは日本に入国する者についての既存の覚書による医学上の処置を行なわなければならない検疫官の許可を得たのちに、彼らを鉄道で佐世保地方引揚援護局に輸送すること
　　ｄ．朝鮮人不法入国者は、この目的のために指定された船舶で佐世保地方引揚援護局からの送還されること
　　ｅ．朝鮮人不法入国者を輸送する列車及び送還船舶への添乗警備に日本警察官を提供すること

５．日本警察の警備及びその活動に協力するために必要な支援及び威信を与えるために必要な連合軍の警備兵は、地方連合国軍の司令官へ申請すれば与えられるであろう

１．Reference is made to:

　　a．Memorandum from the supreme Commander for the Allied Powers, file AG 000.5 (10 Dec 46)GC, SCAPIN 1391), dated 10 December 1946, subject as above.

　　b．Memorandum from the Supreme Commander for the Allied Powers, file AG 370.5 (16 Jul 47)GC-0, (SCAPIN 927/16), dated 16 July 1947, subject: Repatriation, as amended.

２．Paragraph 4 of the reference, paragraph 1 a above, is amended by addition of the following.

　　Sub-paragraph f. Limit the baggage of Korean illegal immigrants being returned to Korea south of 38゜ north latitude to such baggage as is necessary for their personal use to prevent subject illegal immigrants from becoming public charges upon their return to Korea south of 38゜ north latitude. Such baggage will be limited to the amount each such Korean car carry at one time.

　　Sub-paragraph g. Take such steps as are deemed appropriate to assure that no Korean illegal immigrants have in their possession upon their return to Korea south of 38゜ north latitude, either alien registration cards and ration cards of the type issued by the Japanese Government or any falsified official papers and credentials, such as falsified travel orders, which might facilitate illegal entry of Koreans into Japan.

　　Sub-paragraph h. Continue to apply the provisions of paragraph 3a(2), 3b and, Annex �� to the reference paragraph 1b above insofar as these paragraphs apply to Koreans being repatriated from Japan to Korea south of 38゜ north latitude, to Korean illegal immigrants being returned to Korea south of 38゜ north latitude.

MEMORANDUM FOR : IMPERIAL JAPANESE GOVERNMENT.

SUBJECT : Suppression of Illegal Entry into Japan.

１．Reference is made to Central Liaison Office Letter No. 5489 (CL), dated 16 October 1946, subject as above, in which mention is made of so-called "permits" allegedly issued by Allied Forces to various vessels.

２．Japanese vessels on voyages extending outside of Japanese territorial waters are required to carry or board on authorization from the Administrator, Navel Shipping Central Authority for Japanese Merchant Marine (SCAJAP) specifically authorizing such voyage. With this exception, the Supreme Commander for the Allied Powers has authorized the issuance of no other voyage permits.

３．The United States Army Military Government in Korea has advised the Supreme Commander for the Allied Powers that its Bureau of Marine Transportation is the only agent authorized to issue permits to vessels, and that the only vessels now in authorized for foreign trade by order of the above-mentioned Bureau are Baltic Coaster-type cargo vessels and vessels of the Chosen Steamship Company.

４．The Imperial Japanese Government will:

　　ａ．（１）Accept and process at Hakata Reception Center until 27 December 1946 repatriates destined Korea, south of 38゜north latitude, who are eligible for repatriation under the provisions of reference 1 c above but who arrive at Hakata Reception Center after 15 December 1946.

　　　　（２）Outload in shipping to be furnished by the Supreme Commander for the Allied Powers all eligible Korean repatriates from Hakata Reception center not later than 28 December 1946.

　　ｂ．（１）Accept and process at reception centers located at Nagoya, Kure, Kagoshima and Sasebo until 22 December 1946 repatriates destined the Ryukyu Islands who are eligible for repatriation under the provisions of reference 1 b above.

　　　　（２）Outload in shipping to be furnished by the Supreme Commander for the Allied Powers all eligible Ryukyuan repatriates from the Nagoya, Kure, Kagoshima and Sasebo Reception Centers not later than 28 December 1946.

MEMORANDUM FOR : IMPERIAL JAPANESE GOVERNMENT.

SUBJECT : Repatriation of Japanese Nationals from Soviet and SovietControlled Territories, and of Koreans from Japan to Korea North of 38°North Latitude

１．Reference is made to Memorandum from the Supreme Commander for the Allied Powers, file AG 370.05 (7 May 46)GC, (SCAPIN 927), dated 7 May 1946, subject: Repatriation, as amended.

２．ａ．Repatriation of Japanese Nationals from Soviet and Soviet-controlled territories will be accomplished at a rate of approximately 50,000 persons per month effective at once. Repatriates will be processed through reception centers in Japan in general as follows:

　 Area from which repatriated Port in Japan
　 Karafuto and Kurile Islands Hakodate
　 Siberia Maizuru
　 North Korea and Port Arthur Area Sasebo

　　ｂ．The repatriation of not to exceed 10,000 Northern Koreans in Japan, will be accomplished during the period 9 - 15 March 1947 inclusive. This 10,000 will include those 9,701 Koreans who registered prior to 18 March 1946 as being desirous of repatriation provided they were born in Korea north of 38°North Latitude, and such other Koreans desirous of repatriation who were born in North Korea and did not register prior to 18 March 1946 or have changed their minds since that date. Provisions of reference paragraph 1 above will govern except as follows:

　　　　（１）Accompanied baggage shipment is authorized as follows:

　　　　　　　（ａ）Clothing, personal possessions and household effects of value only to the owner, not to exceed 200 kg. per individual.

　　　　　　　（ｂ）Tools, light machinery and business equipment, not exceeding 1,000 kg. in weight, owned outright by them on or prior to 2 September 1945, free and clear of all liens and encumbrances, and used in the operation of their trades or individually operated businesses in Japan.

　　　　（２）Shipment of the items mentioned in paragraph 2 b (1) above, except personal baggage carried by the individual, will be at the expense of the individual concerned. Koreans not authorized for repatriation are not authorized to have property shipped.

　　　　（３）In addition to the prescribed immunizations, typhoid vaccine will be administered to each repatriate.

　　　　（４）Persons with the following diseases will not be placed aboard repatriation ships: typhoid and paratyphoid fevers, plague, typhus, smallpox, cholera, relapsing fever, Japanese "B" encephalitis, pneumonia, influenza, diphtheria, scarlet fever, chicken pox, measles, pertussis, mumps, cerebrospinal meningitis, poliomyelitis, encephalitis "A", and epidemic hemorrhagic fever.

　　　　（５）Persons with the following diseases may be placed aboard repatriation ships, provided the Supreme Commander for the Allied Powers is notified and proper surveillance is maintained enroute to Korea: amebic dysentery, bacillary dysentery, enteritis or diarrhea, malaria, kala azar, tuberculosis, pleurisy, undulant fever and venereal disease.

３．The Imperial Japanese Government will:

　　ａ．Concerning Japanese repatriates mentioned in paragraph 2 a above:

　　　　（１）Make the necessary arrangements to insure that the initial dose of typhus vaccine is administered the first day they are aboard ship.

　　　　（２）Administer the final dose of typhus vaccine upon their arrival at reception centers in Japan.

　　　　（３）Process them in accordance with the instructions contained in reference paragraph 1 above.

　　　　（４）Allow them to retain authorized clothing and equipment issued by Soviet authorities.

　　ｂ．Collect from the ships' masters the lists of articles supplied by the Soviet authorities to the repatriates, and hold such lists in safe keeping pending further instructions.

　　ｃ．Concerning Korean repatriates mentioned in paragraph 2 b above:

　　　　（１）Give maximum publicity at once to all prefectures concerning the date they are to be in the Sasebo Reception Center and the amount of baggage and equipment they are authorized to take with them at their own expense.

　　　　（２）Notify the Supreme Commander for the Allied Powers by 28 February 1947 if the total number who make application for repatriation exceed 10,000 persons, in order that negotiations for repatriation of those exceeding 10,000 may be made.

　　　　（３）In accordance with detailed procedure to be formulated by the Commanding General, Eighth Army, be prepared to perform necessary functions allocated by the Commanding General, Eighth Army in connection with the shipment of property mentioned in paragraph 2 b (1) above.

　　　　（４）Move them to the Sasebo Reception Center during the period 23 February to 9 March 1947 and process them in accordance with the provisions of reference paragraph 1 above, as amended by paragraph 2 b above.

　　　　（５）Outload not to exceed 10,000 Koreans during the period 9 - 15 March 1947 inclusive on shipping designated by the Supreme Commander for the Allied Powers. In addition, make the necessary arrangements to insure that:

　　　　　　　（ａ）All of each repatriate's baggage, tools machinery and equipment, as specified in paragraph 2 b (1) above, are placed on the same ship on which the individual is being repatriated.

　　　　　　　（ｂ）The Sasebo Reception Center officials furnish the ships' masters with five (5) copies of the passenger list, and two (2) copies of a document of transfer (form attached as inclosure 1 hereto), both written in the English language.

　　　　　　　（ｃ）The master of each ship repatriating Koreans:

　　　　　　　　　　１．Furnishes the Soviet authorities at the port of debarkation with four (4) copies of the passenger list.

　　　　　　　　　　２．Upon debarkation of the passengers and their baggage:

　　　　　　　　　　　　ａ．Sign, with the Soviet authorities, the two (2) copies of documents of transfer (inclosure 1).

　　　　　　　　　　　　ｂ．Furnish the Soviet authorities with one (1) copy of the document of transfer.

　　　　　　　　　　３．Make one (1) copy of each of the signed document of transfer and of the passenger list part of the ship's log.

　　ｄ．Provision and fuel ships for the round trip, plus enough fuel, water and food to take care of unforeseen delays.

　　ｅ．Take the necessary measures to insure that the masters of repatriation ships:

　　　　（１）Use the English language when communicating with shore or ship stations in Soviet or Soviet-controlled areas.

　　　　（２）Accept custody of Japanese repatriates, which will be transferred by the Soviet authorities to them according to passenger lists and transfer documents written in the Russian language.

　　　　（３）After verification, sign the transfer documents presented by the Soviet authorities.

　　　　（４）Take special precautions, to include arrival at rendezvous points and ports in Soviet and Soviet-controlled areas during daylight hours, to avoid possible damage to ships and supplies.

　　　　（５）Report to stations in Soviet or Soviet-controlled ports the estimated time of arrival at rendezvous points and ports in Soviet and Soviet-controlled areas six (6) hours prior to arrival thereat.

　　　　（６）Do not accept supplies and/or repairs in Soviet or Soviet-controlled ports, except in dire emergency and unless the seaworthiness of the ships or the safety of the passengers and the crews is endangered by failure to accept such supplies and/or repairs.

　　　　（７）Make a copy of the document of transfer, referred to in paragraph 3 e (3) above, when furnished by the Soviet authorities, part of the ship's log.

　　　　（８）Turn over the list of repatriates, referred to in paragraph 3 e (2) above, to reception center authorities, if only one (1) copy is furnished by Soviet authorities. If more than one (1) copy is furnished, one (1) copy made part of the ship's log and extra copies will be turned over to reception center authorities.

　　ｆ．Inform the ships' masters that the Russian language will be used in all navigation messages issued from ports in Soviet and Soviet-controlled areas.

４．Direct communication is authorized the Imperial Japanese Government in connection with the shipment of Korean-owned property with the Commanding General, Eighth Army.

５．Provisions of reference paragraph 1 above, which are in conflict with instructions contained herein, are amended accordingly.

２．ａ．ソビエト及びソビエト支配下地域からの日本人引揚は、即座に1ヶ月およそ50,000人の割合で達成すること。引揚者は以下の地方引揚援護局を通じて処理すること

　 引揚地区 日本の港
　 樺太及び千島列島 函館
　 シベリア 舞鶴
　 北部朝鮮及び旅順 佐世保

　　ｂ．日本にいる10,000人を超えない北部朝鮮人の送還は、1947年3月9日から15日の間に達成すること。この10,000人は北緯38度以北の朝鮮に生まれ、1946年3月18日に送還希望を登録した者及び3月18日以前に登録していなかったかその後心変わりした者9,701人を含む。上記パラグラフ1の参照の条項は以下のものを除いて規制する。
　　　　（１）同伴する荷物の船積みは以下のとおり認可される
　　　　　　　（ａ）1人あたり200キログラムを超過しない衣服、所有者個人にとってのみ価値のある財産及び家財道具
　　　　　　　（ｂ）1945年9月2日時点かそれ以前に一切の質権・抵当権が設定されておらず送還者が完全に所有する及び送還者の日本における商取引もしくは個人商売で使用されていた、1000キログラムを超過しない道具、軽機械及び商売道具
　　　　（２）上記パラグラフ2b(1)で言及された物品の船積みは、個人によって運ばれる荷物を除き、個人の費用でおこなわれる。送還を許可されない朝鮮人は資産の送出を許可されない
　　　　（３）送還者には、規定された予防接種に加えて腸チフスのワクチンを投与すること

３．日本政府は
　　ａ．上記パラグラフ2で言及された日本人引揚者に関して
　　　　（１）彼らが乗船した最初の日に、初回の発疹チフスワクチンを投与することを確実に処置するのに必要な準備をすること
　　　　（２）日本の地方引揚援護局に到着したとき、最終回の発疹チフスワクチンを投与すること
　　　　（３）上記パラグラフ1の参照に含まれる指示に従って彼らを処理すること

　　　　（１）ソビエト及びソビエト支配下地域の港湾及び船舶施設で意思を疎通するときは英語を使用すること

１．The agreement reached with the Soviets for repatriation of Koreans to Korea north of 38゜North Latitude required the following general modifications from the procedure established by Commanding General, Eighth Army, in Operational Directives Number 77, dated 4 September 1946, subject: Shipment of Limited Amounts of Korean-Owned Property in Japan to Korea:

　　ａ．There will be only one category of Koreans authorized to ship baggage under this program, that is, those now in Japan who are scheduled for repatriation to Korea North of 38゜North Latitude.

　　ｂ．There will be only two classes of property, Class 1 and Class 2, as defined in Operational Directive Number 77. Limiting weight for Class 1 is 440 pounds (200 Kg.), instead of 500 pounds, and for Class 2 is 2,200 pounds (1,000 Kg) instead of 4,000 pounds.

　　ｃ．All such property must be shipped on the same vessel on which the owner is embarked; no person will be repatriated without his baggage, and no shipments of unaccompanied baggage will be permitted.

　　ｄ．The Commanding General, Eighth Army, will be responsible for the successful conclusion of baggage shipment program up to such time as the baggage is transferred to custody of the Soviet authorities at destination, either Genzan or Kanko.

　　ｅ．Rail freight within Japan, trans-shiment and ocean freight charges to Genzan or Kanko based on rates approved by Commanding General, Eighth Army, will be collected in advance on all shipments. Further transportation arrangements after arrival in Korea must be made by the individual at that time.

２．Insofar as possible, existing facilities and procedures shall be employed. However, in view of possible confusion between shipments to the two Korean areas, the procedures and instructions of Operational Directive Number 77 should be reviewed for the purpose of minimizing the chance for misunderstanding and for assuring compliance with the terms of these instructions. It is particularly desired to have repatriates arrive simultaneously with their baggage at Sasebo.

３．It is requested that the Supreme Commander for the Allied Powers be notified of the completion of all arrangements for shipping the subject baggage, in order to coordinate publicity in conjunction with publicity releases on the allied matter of the repatriation program.

４．Concluding date of the program will be 15 March 1947.

５．Direct communication between Commanding General, Eighth Army, the Administrater, Naval Shipping Control Authority for Japanese Merchant Marine (SCAJAP) and the Imperial Japanese Government is permitted insofar as is necessary to insure successful completion of this plan.

２．可能な限り既存の施設及び手続を使用すること。しかし、朝鮮の2つの地区への積荷の混同がありえることからみて、指令��77の手続及び指示は、誤解の機会を最小にし、それらの指示の条件を確実に承諾するために再検討されなければならない。特に佐世保へ送還者と同時に荷物を到着させるよう求められる

３．送還計画に関連のある公共周知とともに広告を調整するため、主題の荷物の輸送の全ての準備の達成について連合軍最高司令官への通知が必要である

４．この計画の終結日は1947年3月15日である

５．第8軍司令官とSCAJAP代表及び日本政府との間の直接連絡は、この計画を確実に成功裏に終結させるため必要な範囲において許可される

１．Reference is made to Memorandum for the Imperial Japanese Government, file AG 370.05 (7 May 46)GC (SCAPIN 927), dated 7 May 1946, subject, "Repatriation", as amended.

２．In order to complete the repatriation of non-Japanese national still in Japan, who are eligible for and desirous of repatriation, and to effect the onward shipment of non-Japanese nationals who are being repatriated via Japan, the following procedures will be followed:

　　ａ．Ryukyuans, Chinese, Formosans and Koreans destined for Korea south of 38゜North Latitude, now in Japan and who are eligible for repatriation, will be assembled at Sasebo Reception Center, processed for shipment, and held in the Sasebo Reception Center pending shipping instructions.

　　ｂ．Repatriates arriving Japan for onward shipment will be received, cared for, assembled at Sasebo Reception Center, processed for shipment and held in Sasebo Reception Center pending arrangements for onward shipping.

　　ｃ．Repatriates will be embarked on shipping as designated.

３．In view of the fact that outgoing repatriates will often be in small groups, it will be necessary to utilize shipping other than that regularly assigned to repatriation service. In such cases the Imperial Japanese Government will provision the ships to accommodate the repatriates to be embarked in the same manner as prescribed for regular repatriation shipping.

４．Upon notification that repatriates are to be outloaded on other than repatriation shipping, the Imperial Japanese Government will:

　　ａ．Provision the ships in accordance with above instructions.

　　ｂ．Move the repatriates from Sasebo Reception Center to the port from which the ship is scheduled to depart, coordinating the movement so that repatriates will be in the port of departure a minimum length of time.

　　ｃ．Instruct the masters of the ships in the procedures to be followed in receiving repatriates, care of repatriates while aboard ship, and delivery to appropriate authorities at the port of debarkation.

５．Ryukyuan repatriates will be outloaded as shipping is available and not to exceed:

　　ａ．300 for Okinawa and 200 for Amami O'shima aboard each ship.

　　ｂ．One ship per week.

２．The Kishin Maru has been designated to lift approximately 10O Korean illegal immigrants from Sasebo to Pusan, Korea, and 265 Japanese nationals and 17 Formosans from Pusan to Sasebo. Five of these Formosans are being deported from Korea. The ship will depart from Sasebo on or about 25 February 1947.

３．The Imperial Japanese Government will:

　　ａ．Place approximately 100 Korean illegal immigrants, now at Sasebo, aboard the Kishin Maru.

　　ｂ．Furnish sufficient Japanese guards aboard ship to insure delivery of Korean illegal immigrants the custody of the Commanding General, �将将� Corps.

　　ｃ．Direct Japanese guards to accept custody at Pusan, Korea, of the 5 Formosan deportees and insure their delivery to proper authorities at the Sasebo Reception Center.

　　ｄ．Receive and process Japanese being repatriated from Korea in accordance with the provisions of reference paragraph 1a above.

　　ｅ．Receive, process and hold the 17 Formosan repatriates at the Sasebo Reception Center pending arrangements for onward shipping, in accordance with the provisions of reference paragraph 1c above.

　　ｆ．Insure the 5 Formosan deportees are held under guard until they can be shipped to Formosa.

４．Allied guards will not be placed aboard the Kishin Maru.

２．The request submitted by the Imperial Japanese Government to utilize twenty-eight (28) SCS's (auxiliary subchasers) and ten (10) PCS's (auxiliary patrol craft) to reinforce present measures against illegal entry and smuggling into Japan, is approved subject to the following conditions.

　ａ．That the vessels concerned be turned over to the Maritime Bureau of the Ministry of Transportation.

　ｂ．That the additional vessels be utilized to increase present activities related to reestablishment of navigational aids, elimination of hazards to navigation and other related maritime safety activities.

　ｃ．That these vessels be unarmed.

３．Vessels referred to in paragraph 2 above are subject to recall by the Supreme Commander for the Allied Powers. Upon notification by the Commander, Naval Forces, Far East, these vessels will be returned to the Supreme Commander for the Allied Powers by the Imperial Japanese Government within thirty (30) days.

３．Concerning Koreans mentioned in paragraph 2 above, the Imperial Japanese Government will:

　　ａ．Notify them that this is their last chance for repatriation until such time as commercial facilities are available.

　　ｂ．Move them to the Sasebo Reception Center during the period 15 June to 20 June 1947 and process them in accordance with the provisions of reference paragraph 1 a above, as amended by paragraph 2 b (1) through 2 b (5) of reference paragraph 1 b above.

　　ｃ．Outload them on the ship to be designated. In addition, make necessary arrangements to insure that:

１．The islands of Liancourt Rocks (or Take Shima), located 37°15′north, 131°50′east, are designated as a bombing range.

２．The inhabits of Oki-Retto (Oki-Gunto) and the inhabitants of all the ports on the west coast of the island of Honshu north to the 38th parallel, north latitude, will be notified prior to each actual use of this range. This information will be disseminated through Military Government units to local Japanese civil authorities.

SUBJECT : Repatriation and Shipment of Property of Koreans to Korea on Board their Own Ships

１．Reference is made to C.L.O. No. 9481(RF), subject as above, dated 10 December 1947, in which information is requested concerning shipment of Korean-owned property to Korea by Category �� Koreans.

２．The Supreme Commander will continue to approve applications for shipment of Class �� property in accordance with the provisions of paragraph 4b, 0perational Directive No. 77, Headquarters Eighth Army, 4 September 1946. Notification of approval will be given by a representative of Commanding General, Eighth Army in accordance with the provisions of paragraph 5, SCAPIN 1092, 30 July 1946, subject, "Shipment of Limited Amounts of Korean-Owned Property in Japan."

３．The Japanese Government will furnish fuel and/or other materials on a revenue basis when directed to do so by Occupation authorities.

４．Repatriation of individuals concerned in each instance will continue to be authorized by the Supreme Commander for the Allied Powers.

SUBJECT : Property Individuals are Authorized to Carry on Entering and Leaving Japan

１．This memorandum is the basic directive governing property brought into and taken out of Japan by individuals entering and leaving Japan, i.e. the four main islands of Hokkaido, Honshu, shikoku, and Kyushu, and outlying islands under the control of the Occupation Forces. The provisions of this directive apply to all Japanese and to foreign nationals who are not members of or accredited to the Occupation Forces.

２．Previous instructions, as contained in the memoranda listed in attached Annex �� are superseded by this directive.

３．In the future, insofar as practical, all general directives concerning movement of property into and out of Japan by individuals referred to in paragraph 1 above will be issued in the form of additions or amendments to this memorandum.

４．Definitions of the terms used in this memorandum are set forth in Annex �� attached hereto.

５．The Japanese Government is directed to carry out the provisions of this memorandum as contained in annexes attached hereto, under the surveillance of the Commanding General, Eighth United States Army.

６．Six copies of the applicable laws, implementing the provisions of this memorandum shall be furnish to General Headquarters, Supreme Commander for the Allied Powers. Such copies shall contain the English and Japanese text.

Memorandum for the Japanese Government, SCAPIN 1966, dated 18 Jan 49

DEFINITIONS

　１．The term "currency" as used herein shall include coin, notes or other instruments issued by authorized authorities designed as and intended for a circulating medium.

　２．The term "acceptable foreign exchange" shall include currencies and financial instruments expressed in terms of currencies which are registered with the International Monetary Fund or recognized as acceptable in foreign markets.

　３．The term "financial instrument" shall include checks, or other orders to pay, securities commonly dealt in by bankers, brokers, and investment houses, drafts, notes, debentures, stocks, bonds, coupons, acceptances, mortgages, pledges, insurance policies, liens or other rights in the nature of security, trust, warehouse and other receipts, bills of lading, bills of exchange, bills of sale, sales agreements, contracts, certificates of deposit, bank pass books, or any other written evidence of title, ownership or indebtedness.

　４．The term "property" shall include currency, bullion, financial instruments, bank deposits, savings accounts, any debts, indebtedness or obligations, wares, merchandise, chattels, stocks on hand, ships, goods on ships, real estate and any interest therein, leaseholds, ground rents, options, royalties, book accounts, accounts receivable, judgments, patents, trademarks, copyrights, contracts or licenses affecting or involving patents, the rights and interest in safe deposit boxes and the contents thereof, annuities, pooling agreements and any other rights or title of interest.

　５．The term "evidences of ownership" will include, but not by way of limitation, securities, title deeds, mortgages, bank pass books, receipts, checks, drafts, promissory notes, bills of exchange, certificates of title and indebtedness, copyrights, trademarks and patents and other written evidence of title, right or interest in property.

　６．The term "personal effects" will include luggage, clothing, books, toilet articles, an automobile, articles of personal jewelry, and other effects intended and reasonably necessary for the personal use of the individual.

　７．The term "household articles" will include items intended and reasonably necessary for the use of an individual and his family in establishing or maintaining living accommodations.

　８．The term "professional instruments" will include tools of trade which are intended for and reasonably necessary to a normal individual vocation or avocation.

　９．Persons accredited to the Occupation Forces shall include:

　　　ａ．Allied Occupation Forces personnel, military and civilian, who have entered Japan under official orders, and have not severed their connection with the Occupation Forces;

　　　ｂ．Official organizations of the Allied Powers, military, naval, air force units and diplomatic missions;

　　　ｃ．All dependents of persons in categories a and b above.

１０．The term "foreign national" shall be considered to mean any person not a member of accredited to the Occupation Forces who:
　　　ａ．Possesses nationality other than Japanese and can present satisfactory evidence thereof;

　　　ｂ．Is stateless and not formerly a Japanese national.

１１．Commercial entrants are these persons authorized to enter Japan by the Supreme Commander for the Allied Powers under the provisions of Circular No. 3. General Headquarters, Supreme Commander for the Allied Powers, subject. Private Commercial Entrants, dated 25 February 1948. For purposes of this directive commercial entrants are considerd as foreign nationals and are not to be considered as members of or accredited to the Occupation Forces.

　　　ａ．占領軍と関係のある者、公式命令を受け日本に入国し占領軍との関係を絶っていない軍人及び文民

１０．「外国人」の用語は、以下の占領軍の信任を受けない者を意味すると考慮される

POLICY GOVERNING ENTRY AND EXIT OF PROPERTY OF INDIVIDUALS ENTERING AND LEAVING JAPAN

SECTION ��

General

１．The following policies will govern the movement of property of all Japanese and foreign nationals entering or leaving Japan.

２．The Japanese Government will prevent and prohibit, except as specifically authorized by the Supreme Commander for the Allied Powers, the exportation or withdrawal from Japan to any foreign country, or the importation into Japan from any foreign country, of any of the following:

　　ａ．Gold or silver coin, gold, silver or platinum bullion or alloy thereof in bullion form and other precious metals and precious stones except personal jewelry worn or carried in personal baggage accompanying the owner;

　　ｂ．Counterfeit, altered or imitation coins;

　　ｃ．Bank of Japan yen currency and foreign currencies listed in Annex �� hereto;

　　ｄ．Any book, pamphlet, paper, writing, advertisement, circular print, picture or drawing, containing any matter advocating or urging treason or insurrection against any government;

　　ｅ．Any item of a pornographic nature;

　　ｆ．Any narcotic drug or utensil used therefor;

　　ｇ．Weapons of any nature, gun powder and other explosives, except that ammunition for hunting purposes may be entered in a reasonable amount for personal use;

　　ｈ．National treasures of any country and important art objects;

　　ｉ．Articles which infringe upon rights in patents, utility models, trademarks, and copyrights.

３．The Japanese Government is authorized to exchange at ports of entry Bank of Japan yen currency for United States dollar currencies at the military conversion rate upon the consent of the person in possession of the currency. United States dollars so exchanged will accrue to a commercial account designated by the Supreme Commander for the Allied Powers. United States dollar currencies not exchanged for Japanese yen at the port of entry will be taken up from persons entering Japan and treated as follows:

　　ａ．Deposited in the Bank of Japan against a receipt negotiable at a licensed foreign bank in Japan to be availed of in accordance with existing foreign exchange control regulations of the Supreme Commander for the Allied Powers, or

　　ｂ．At the request of the individual surrendering the currency, held in safe keeping against receipt in the Bank of Japan to be returned to the individual on his departure from Japan or exchanged at a later date for the following:

　　　　（１）A negotiable receipt as authorized in paragraph 3a above, or

　　　　（２）Japanese yen at the military conversion rate,

４．The Japanese Government will take up all Bank of Japan yen currencies from persons entering and leaving Japan as directed in paragraph 2c above, to be held in accordance with instructions herein. Special disposition will be made of Japanese yen taken up from persons being repatriated from Japan to Korea and to the Ryukyu Islands as follows:

　　ａ．The Japanese Government is directed issue a receipt promising payment in Japan to the Government of the Republic of Korea for Bank of Japan yen currency taken up from persons being repatriated from Japan to Korea in amounts not to exceed 100,000 yen per head of a family. The receipt will be issued to the person surrendering the currency who is authorized to carry the receipt on departure from Japan to the Government of the Republic of Korea for payment in local currencies.

　　ｂ．The Japanese Government is directed to issue a receipt promising payment in Japan to the Ryukyus Custody Account, National City Bank of New York, Tokyo Branch, for Bank of Japan yen currency taken up from persons being repatriated from Japan to the Ryukyu lslands in amounts not to exceed 100,000 yen per head of a family. The receipt will be issued to the person surrendering the currency who is authorized to carry the receipt departure from Japan for presentation to the Ryukyus Military Government for payment in local currency.

　　ｃ．Receipts referred to in paragraphs a and b above will be issued by branches and agencies of the Bank of Japan at repatriation centers.

　　ｄ．Japanese yen currency taken up from persons being repatriated to Korea and the Ryukyu Islands in excess of 100,000 yen will be held in accordance with paragraph 5b below.

５．The Japanese Government will take up from persons entering or leaving Japan all items included in paragraph 2 above other than those specifically authorized herein. Items taken up will be disposed of in the following manner:

　　ａ．Gold, silver or platinum bullion or alloy thereof in bullion form will be purchased from the owner by the Japanese Government at the Japanese Government buying rate, payments to be made in yen;

　　ｂ．New Bank of Japan yen currency and Imperial Japanese yen will be held in safe keeping in the Bank of Japan to the account of the individual surrendering the currency against individual receipt pending further direction from the Supreme Commander for the Allied Powers.

　　ｃ．Gold and silver coin and foreign currency other than United States dollar currencies will be taken up from persons entering Japan against individual receipt and placed to the account of the individual in the Bank of Japan to be returned to the individual on departure from Japan or otherwise disposed of by direction of the Supreme Commander for the Allied Powers;

　　ｄ．Counterfeit, altered and imitation coins, narcotic drugs and utensils therefor, items of pornographic nature, and books, pamphlets, papers, etc., containing any matter advocating or urging treason or insurrection against any government, articles which infringe upon rights and patents, utility models, trade-marks and copyrights, and weapons of any nature, gun powder and other explosives will be turned over to or otherwise disposed of at the direction of the Commanding General, Eighth United States Army;

　　ｅ．Precious metals other than gold, silver, and platinum in any form, precious stones, national treasures of any country, and important art objects will be turned over to General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian.

６．The Japanese Government will submit monthly reports to Commanding General Eighth United States Army, of items taken up containing the name, nationality, and address of the persons concerned, and the amount and description of the items taken into custody, the port where items were impounded and all other pertinent information.

７．The Japanese Government will require each individual entering or departing from Japan other than persons accredited to the Occupation Forces, to prepare and sign a declaration of property taken into or out of Japan, a copy of which is attached hereto as Annex ��. Any undeclared item found in possession of an individual on entering or leaving Japan will constitute act of illegal trade and will be dealt with in accordance with Memorandum for the Japanese Government, file AG 091.31 (4 Jun 46)ESS/PC, SCAPIN 996, dated 4 June 1946, subject: Illegal Import and Export Trade. Persons untitled to diplomatic immunity will not be required to submit to search of personal effects but will sign declaration referred to above.

日本に入国及び出国する個人の財産の持込み及び持出しについての統制方針

セクション1

総則

１．以下の方針は、全ての日本人及び日本に入国もしくは出国する外国人の財産の移動を規制する

２．日本政府は、特に連合軍最高司令官の許可を受けたものを除き、以下のものについて、日本から外国への輸出もしくは回収、または外国から日本への輸入を防ぎ禁止すること

　　ａ．金貨もしくは銀貨、金塊、銀塊またはプラチナ地金もしくは合金及び他の貴金属、所有者が着用もしくは手荷物として携行する個人装身具以外の宝石
　　ｂ．偽造、変造もしくは模造硬貨
　　ｃ．日本銀行券及びこの文書に付属する附則3に記載される外国貨幣
　　ｄ．あらゆる政府に対する反逆もしくは反乱を支持もしくは主張する内容を含むあらゆる書籍、パンフレット、紙、文書、広告、案内状、写真もしくは絵画
　　ｅ．あらゆるポルノ性物品

３．日本政府は、通関手続きで貨幣を所有する個人の同意を得て日本銀行円貨幣を軍の交換レートで米ドルに交換することを許可される。交換される米ドルは連合軍最高司令官に指定された商業的口座に置かれる。通関手続きで日本円に交換されない米ドルは日本 に入国する者から取上げられて以下のように取扱われる
　　ａ．日本にある公認された外国銀行に流通性のある受領証と引換えに日本銀行に預けられ、連合軍最高司令官の既存の為替管理規則に従って利用される。もしくは
　　ｂ．貨幣を引渡している個人の要望により、受領証と引換えに日本銀行で安全に保管され日本を出国時に返還されるか、もしくは後日以下のように交換される
　　　　（１）上記パラグラフ3aで許可された流通性のある受領証、もしくは
　　　　（２）軍の交換レートによる日本円

４．日本政府は、上記パラグラフ2cに指示された日本に入国及び出国する者から全ての日本銀行円貨幣を取上げ、そこの指示に従って保管すること。日本から韓国及び琉球諸島に送還される者から取上げられる日本円は以下のとおり特別な処分を為される
　　ａ．日本政府は、日本から韓国に送還される者から取上げた家族一人当たり総計100,000円を超えない日本円について、日本で大韓民国政府の支払を約束する受領証を発行することを指示される。受領証は、貨幣を引渡しており、日本からの出国時に大韓民国政府が現地貨幣で支払う受領証の携行を許可された者に発行される
　　ｂ．日本政府は、日本から琉球諸島に送還される者から取上げた家族一人当たり総計100,000円を超えない日本円について、日本で琉球保護口座、国立ニューヨーク市銀行東京支店の支払を約束する受領証を発行することを指示される。受領証は、貨幣を引渡しており、日本からの出国時に琉球軍政庁に現地貨幣で支払うよう提示する受領証の携行を許可された者に発行される
　　ｃ．上記パラグラフa及びbで言及された受領証は地方引揚援護局にある日本銀行支店及び代理店によって発行される
　　ｄ．韓国及び琉球諸島に送還される者から取上げられた100,000円を超える日本円貨幣は、下記パラグラフ5bに従って保管される

５．日本政府は日本に入国及び出国する者から、ここで特に許可されたもの以外の上記パラグラフ2に含まれる全ての物品を取上げること。取上げられた物品は以下の方法で処分される
　　ａ．金、銀もしくはプラチナの地金あるいは地金形の合金は、日本政府の購入レートによって日本政府が日本円払いで所有者から購入する
　　ｂ．新しい日本銀行円貨幣及び帝国日本円は、連合軍最高司令官の更なる指示があるまで、受領証と引換えに貨幣を引渡している個人の日本銀行の個人口座に保管される
　　ｃ．金貨、銀貨及び米ドル以外の外国貨幣は、日本に入国する者から受領証と引換えに取上げられ、日本銀行の個人口座に置かれ出国時に返還されるか、さもなければ連合軍最高司令官の指示によって処分される
　　ｄ．偽造、変造及び模造硬貨、麻薬及びそれに付随する用具、ポルノ性物品、あらゆる政府に対する反逆もしくは反乱を支持もしくは主張する内容を含むあらゆる書籍、パンフレット、紙等、特許、実用新案、商標及び著作権を侵害するもの、あらゆる性質の武器、火薬及びその他の爆薬は、米第8軍司令官に引渡されるか、さもなければその指示によって処分される
　　ｅ．金、銀及びプラチナ以外のあらゆる形の貴金属、宝石、あらゆる国の国宝及び重要文化財は、連合軍最高司令官、民間資産管理者に引渡される

６．日本政府は、取上げた物品に関係する氏名、国籍及び住所を含む、保管した物品の量と種類、港に於いて押収された物品とそれに関係する全ての情報についての月報を連合軍最高司令官に提出すること

７．日本政府は、占領軍の信任を受けた以外の日本に入国もしくは出国する者に、日本に持ち込むもしくは持ち出す財産の申告(ここに付属する附則6の複写)の準備と署名を要求すること

SECTION ��

Forign Nationals Entering and Leaving Japan

１６．Foreign nationals are permitted to bring in or take out the following on entering and leaving Japan:

　　　ａ．Personal effects intended solely for the use of the person entering or leaving Japan;

　　　ｂ．Financial instruments, personal bank books, insurance policies, savings certificates, receipts, evidences of ownership of property in Japan, powers of attorney, proxies, or other authorizations or instruments to effect financial or property transactions within or outside of Japan. Any variance in such authorizations or instruments taken out of Japan as compared with those brought into Japan must be substantiated by accepted evidence of legal acquisition.

１７．Individuals authorized by the Supreme Commander for the Allied Powers to enter Japan for business purposes may import bona fide samples and in addition may import commercial item necessary and appropriate in the conduct of their authorized business, which do not exceed $500.00 in value. Such license-free importation shall be on a "one-time" basis. All items brought into Japan by individuals authorized by the Supreme Commander for the Allied Powers to enter Japan for business purposes may be taken out of Japan by the person who imported them.

１８．In addition to articles which foreign nationals may carry on entering and leaving Japan as authorized in paragraph 16 above, Koreans, Formosans, Ryukyuans and Chinese who are eligible for repatriation from Japan to their homelands are authorized unaccompanied shipment of the following:

　　　ａ．Household articles except as specifically prohibited by this directive;

　　　ｂ．Professional instruments not exceeding 4,000 pounds in weight, free and clear of all liens and encumbrances, and used in the operation of their trade or individually operated business in Japan. Any such property weighing in excess of 4,000 pounds may be removed from Japan only on the approval of the Supreme Commander for the Allied Powers. Disposition or storage for safekeeping of such property in excess of 4,000 pounds will be the sole responsibility of the individual repatriated.

１９．Foreign currencies as listed in Annex �� hereto will be taken up from persons entering Japan against individual receipt as directed in paragraph 5c above or may be exchanged as authorized in paragraph 3 above.

２０．Foreign national leaving Japan will be permitted to take foreign currencies surrendered on entering Japan as authorized in paragraphs 3b and 5c above, and also United States dollars and/or pounds sterling, provided the person has in his possession an authorization of General Headquarters, Supreme Commander for the Allied Powers to take out of Japan the amount of currency specified in the authorization.

２１．Koreans and Ryukyuans leaving Japan as repatriates may take with them negotiable receipts issued by the Japanese Government against Bank of Japan yen currency taken up at ports of exit, as authorized in paragraph 4 above.

セクション4

日本に入国及び出国する外国人

１６．外国人は、日本に入国及び出国するさい、以下のものを持ち込むこと及び持ち出すことを許可される
　　　ａ．単に日本に入国もしくは出国する個人の使用を目的とした所持品
　　　ｂ．金融手段、個人預金通帳、保険証書、貯蓄公債、受領証、日本に於ける財産所有の証拠、弁護士、代理人の委任状、もしくは日本国内或いは国外に於いて金融的もしくは資産的取引の生じる他の認可あるいは文書。日本から持ち出される認可もしくは文書のあらゆる相違は、日本に持ち込まれるそれらと比較して、認められた法的獲得の証明によって実証されなくてはならない

１７．連合軍最高司令官に商業目的の日本入国を許可された個人は、商品のサンプルを輸入し、加えて認可された商業の処理に必要且つ適当な商業的物品を輸入するが、その価値は500ドルを超えないこと。そのような許可なしの輸入は原則「一回」だけのものである。連合軍最高司令官に商業目的の日本入国を許可された個人によって日本に持ち込まれる全ての物品は、それらを輸入した者によって日本国外に持ち出されること

１８．上記パラグラフ16で許可された外国人が日本に入国及び出国時に持ち込む物品に加えて、日本から本国への送還資格を有する韓国人、台湾人、琉球人は以下の別送品を許可される
　　　ａ．この指示で特に禁止されたものを除く家財
　　　ｂ．重量4,000ポンドを超えないもので、一切の質権・抵当権が設定されておらず、日本での取引もしくは個人商売の活動に使用される専門器具。4,000ポンドを超えるあらゆるそのような財産は、連合軍最高司令官の承認のみによって日本から移動される。4,000ポンドを超えるそのような財産の預入或いは保管は、単に送還される個人の責任である

１９．上記パラグラフ5cで指示されたように、附則3に記載された外国貨幣は受領証と引換えに日本に入国する個人から取上げられ、上記パラグラフ3aで許可されたように交換される

２０．日本を離れる外国人は、上記パラグラフ3b及び5cで許可されたように、日本入国時に引渡している外国貨幣を持ち出すことを許可され、その上、米ドル及び或いは英ポンドは、連合軍最高司令官による所有許可を得た場合、特に許可された貨幣の総額を日本国外に持ち出せる

２１．送還者として日本を離れる韓国人及び琉球人は、上記パラグラフ4で許可されたように、出国手続で取上げられた日本銀行円貨幣と引換えに日本政府によって発行された流通性のある受領証を持ち出せる

３．The Japanese government will immediately take the necessary action to:
　ａ．Assign the necessary immigration officials to the Customs Detachment currently operating under the supervision of the Commanding General Eighth Army, at each port of entry designated by Circular 19, General Headquarters, Supreme Commander for the Allied Powers, 1948, and amendments and supersedures thereto. The Immigration officials will be under the direct supervision of the Commanding General, Eighth Army.
　ｂ．The Japanese Government will establish a central office of record for all clearance granted by the Supreme Commander for the Allied Powers to individuals entering or departing Japan, except occupation force personnel traveling under official orders. This office of record will be known as the "Central Locator Files" and will serve to inform the immigration officials of the Japanese Government working under the supervision of the Commanding Gえneral, Eighth Army, of all clearances granted by the Supreme Commander for the Allied Powers. The Central Locator Files will be maintained with sufficient Englishspeaking personnel on a twenty-four hour basis to receive information from the Supreme Commander for the Allied Powers concerning individuals authorized by him to enter or depart Japan. Upon receipt of such information, the Central Locator Files will notify the immigration officials of the Japanese Government of the clearances granted by the Supreme Commander for the Allied Powers.

４．In order that the Central Locator Files may receive infoｒmation of clearances granted by the Supreme Commander for the Allied Powers, it is desired at that a messenger visit the General Headquarters, Supreme Commander for the Allied Powers, promptly at 1200 each Tuesday, Thursday and Saturday to receive a list of clearances.

５．Effective 1 November 1949, the Japanese Government will be responsible for the prevention of the illegal entry of any individual into Japan. It is desired that particular emphasis be placed on entry of individual through those ports not recognized by the Supreme Commander for the Allied Powers as official ports of entry. Necessary action will be taken by the Japanese Government to deport individuals apprehended as illegal entrants, or individuals who are otherwise in Japan without authority.

４．「セントラル・ロケーターズ・ファイルズ」が連合軍最高司令官により与えられた許可の情報を得るため、伝書使が毎週火曜・木曜・土曜の正午に連合軍最高司令部に出頭し許可リストを受け取ることが望ましい

５．1949年11月1日より、日本政府は、個人の日本への不法入国を防ぐ責任を負う。このような措置に際し特に連合軍最高司令官により正式入国港として認められてない港からの入国に重点を置くことが望ましい。日本政府により不法入国者として逮捕された者及び許可なしで日本に在留する者の追放に必要な措置が執られること

Personnel from such vessels will not land on any such land areas, nor have contact with any inhabitants thereof, except in cases of serious emergency and provided permission to enter is obtained from local authority prior to such emergency entry.

５．The present authorization does not establish a precedent for any further extension of authorized fishing areas.

６．The present authorization is not an expression of allied policy relative to ultimate determination of national jurisdiction, international boundaries or fishing rights in the area concerned or in any other area.

１．Rescission: Memorandum, GHQ SCAP, AG 684 (16 Sep 47) GC-TNG, SCAPIN 1778, subject: Liancourt Rocks Bombing Range, 16 September 1947.

２．The islands of Liancourt Rocks (Take Shima), located 37°15′North, 131°52′East, are designated as a bombing range.

３．The danger areas of this range are as described:

　　ａ．Surface Danger Area - The area within a five mile radius of Liancourt Rocks 37°15′N - 131°52′E.

　　ｂ．Air Space Danger Area - The airspace within a five mile radius of Liancourt Rocks 37°15′N - 131°52′E extending to an altitude of 30,000 feet..

４．The inhabitants of Oki-Retto (Oki-Gunto) and the inhabitants of all the ports on the west coast of the island of Honshu north to the 40th parallel, north latitude, will be notified fifteen days prior to use of this Range. When the Range is used for periods in excess of fifteen days, warning reminders will be disseminated to the inhabitants indicated above every fifteen days. This information will be forwarded through the Government Section, General Headquarters, Supreme Commander for the Allied Powers to the Japanese Government for dissemination to the local civil authorities in the areas concerned.

１．1947年9月16日付SCAPIN1778「竹島爆撃演習場」を無効とする

２．北緯37度15分、東経131度52分に位置するリアンクール岩(竹島)を爆撃演習場に指定する

３．この範囲の危険区域を示す
　　ａ．危険水域―北緯37度15分、東経131度52分のリアンクール岩から半径5マイル以内の区域
　　ｂ．危険空域―北緯37度15分、東経131度52分のリアンクール岩から半径5マイル以内の高度3000フィート空域

４．この演習場の実際の使用の15日前に、隠岐列島(隠岐群島)の住民及び北緯40度線の本州西海岸の全ての港の住民に通知する。この範囲が15日以上使用されるとき、15日おきに上述された住民に対して警告を周知する。この情報は、関係地域の地方行政当局に周知するために連合軍最高司令部の部局を通じて日本政府へ発送される
